بيان صحفي بمناسبة اليوم العالمي للإنصاف في الأجور

في اليوم العالمي للإنصاف في الأجور: حماية الأجر هي حماية للحياة، وإعادة هيكلة منظومة الحماية الاجتماعية أولوية لا تحتمل التأجيل
في الثامن عشر من أيلول/سبتمبر من كل عام، يحتفل العالم باليوم العالمي للإنصاف في الأجور كمناسبة للتأكيد على المساواة والعدالة بين العاملات والعاملين. غير أننا في فلسطين نقف أمام واقع استثنائي يُعجز كل المفاهيم النظرية للعدالة الاجتماعية والحماية الاقتصادية؛ إذ لم يعد مطلبنا يقتصر على تحقيق المساواة الإجرائية في الأجور فحسب، بل يتعداه إلى المطالبة بـ “حماية الحياة” وتأمين الحد الأدنى من مقومات الصمود الإنساني.
إن الأجر في الفكر النقابي والواقع الاجتماعي الفلسطيني ليس مجرد رقم حسابي، بل هو المورد الأساسي والوحيد للوفاء بالحاجات الأساسية للأسر. وفي ظل الظروف القاسية والمتغيرات العميقة التي يمر بها سوق العمل الفلسطيني، تبرز تحديات متفاقمة تتطلب وقفاً فوريّاً أمام آليات الحماية الاجتماعية:
* معدلات بطالة غير مسبوقة: تُشير البيانات والتقديرات الرسمية إلى وجود مئات الآلاف من المتعطلين عن العمل في الضفة الغربية وقطاع غزة، حيث تتراوح أعداد العاطلين عن العمل حول مستويات كبرى تتجاوز نصف مليون عاطل، وسط ارتفاع حاد في معدلات البطالة التي وصلت إلى مستويات غير مسبوقة بسبب الإغلاقات والعدوان والتضييق الاقتصادي.
* عدم الالتزام بالحد الأدنى للأجور: تفيد بيانات الجهاز المركزي للإحصاء الفلسطيني بأن نسبة مرتفعة من العاملين في القطاع الخاص (وبخاصة النساء) لا يتقاضون الحد الأدنى للأجور المعتمد (1880 شيقلاً). وتتضاعف هذه الفجوة لدى العاملات في قطاعات الغزل، النسيج، دور الحضانة، والخدمات الخاصة.
* ارتفاع نسبة الأسر التي تعيلها نساء: تشهد التوزيعات الديموغرافية والاجتماعية ارتفاعاً متزايداً في نسبة النساء المعيلات للأسر، واللائي يواجهن ظروف عمل هشة وأجوراً دون المستوى الأدنى القانوني، مما يُعرض أسرهن لفقر متعدد الأبعاد.
* غياب البيئة التمكينية لذوي الإعاقة: تتزايد أعداد ذوي الاحتياجات الخاصة والقدرات المختلفة في المجتمع، دون وجود ضوابط ملزمة تضمن استيعابهم في سوق العمل وحمايتهم بأجور عادلة تضمن لهم الحياة الكريمة.
استحقاقات دولية واتفاقيات عمل أساسية
نُذكر في هذا اليوم بالالتزامات الدولية والوطنية، وعلى رأسها:
1. اتفاقية منظمة العمل الدولية رقم (100) بشأن المساواة في الأجور (Equal Remuneration Convention, 1951): والتي تنص صراحة على المساواة بين العمال والعاملات في الأجر عن عمل ذي قيمة متساوية دون تمييز جنساني.
2. قرارات الحد الأدنى للأجور والسياسات الوطنية ذات الصلة: والتي تفرض ملاءمة الأجور مع غلاء المعيشة ومستويات الفقر الوطنية، وضمان تطبيقها الفعلي على كافة المنشآت.
مطالب ودعوة للعمل العملي
إن المرحلة الحالية تؤكد أن العامل والطبقة العاملة الفلسطينية ليسوا وحدهم من يجب أن يدفعوا ثمن الأزمات المركبة. وبناءً عليه، نطالب بالآتي:
1. إعادة تفعيل لجنة الإنصاف في الأجور: بصفتها الإطار الوطني الجامع والمصمم لمتابعة الفجوات ومراجعة سياسات الأجور بشكل دوري.
2. تفعيل لجنة الأجور وإقرار دورية اجتماعاتها: إقرار عقد اجتماعات لجنة الأجور بصورة دورية ومستمرة لضمان مراجعة الأجور ومعدلات غلاء المعيشة وربط الحد الأدنى للأجور بالتغيرات الاقتصادية المتلاحقة.
3. إعادة المتابعة والمراقبة الدورية للحد الأدنى للأجور: وإلزام كافة مواقع العمل بالحد الأدنى المحدد قانوناً دون استثناءات.
4. تطوير وتفعيل لائحة الجزاءات: مراجعة وتعديل لائحة نظام الجزاءات الخاصة بالمخالفين لتطبيق الحد الأدنى للأجور، وتغليظ العقوبات لتصبح رادعة وعادلة.
5. تعزيز دور جهاز التفتيش بوزارة العمل: تفعيل دور المفتشين
وإ بإصدار تقارير شهرية علنية تتضمن حجم المخالفات والأحكام الصادرة بشأنها في مختلف القطاعات الإنتاجية والخدمية.
6. إصلاح شامل لمنظومة الحماية الاجتماعية: ربط منظومة الأجور بالضمان الاجتماعي والتأمين الصحي والتأمين ضد البطالة، لحماية الفئات الأكثر هشاشة.
التحالف العالمي للإنصاف في الأجور (EPIC)
من هذا المنبر، نعلن انحيازنا الكامل وأهمية رفع صوت الحركة النقابية الفلسطينية عبر التحالف العالمي للإنصاف في الأجور (Equal Pay International Coalition - EPIC).
إن الانخراط الفاعل والارتقاء بمعايير عمل التحالف يُعد مدخلاً استراتيجياً لتوحيد جهود الحركة النقابية الشريكة على المستوى الدولي، ولرفع الصوت الفلسطيني عالياً في المحافل الأمية ودول العالم؛ للضغط باتجاه تحقيق إنصاف حقيقي للعمال والعاملات، وتوفير بيئة عمل لائقة تصون الكرامة الإنسانية وتحمي حق شعبنا في الحياة والعدالة الاجتماعية.

Press Statement on World Day for Pay Equity

On World Day for Pay Equity: Protecting Wages Means Protecting Life, and Restructuring the Social Protection System Is an Urgent Priority
On the eighteenth of September every year, the world marks World Day for Pay Equity as an occasion to reaffirm equality and justice between women and men workers. However, in Palestine, we face an exceptional reality that challenges all theoretical concepts of social justice and economic protection; our demand is no longer limited to achieving procedural equality in wages, but extends to calling for “protecting life” and securing the minimum conditions necessary for human resilience.
In Palestinian trade union thinking and social reality, wages are not merely a numerical figure; they are the primary and only resource for meeting the basic needs of families. In light of the difficult conditions and profound changes facing the Palestinian labour market, growing challenges are emerging that require immediate action regarding social protection mechanisms:
* Unprecedented unemployment rates: Official data and estimates indicate the existence of hundreds of thousands of unemployed people in the West Bank and Gaza Strip, with the number of unemployed reaching major levels exceeding half a million, amid a sharp rise in unemployment rates that have reached unprecedented levels due to closures, aggression and economic restrictions.
* Non-compliance with the minimum wage: Data from the Palestinian Central Bureau of Statistics indicate that a high proportion of workers in the private sector (particularly women) do not receive the approved minimum wage (NIS 1,880). This gap is even greater among women workers in the garment, textile, nursery and private services sectors.
* Increase in the proportion of female-headed households: Demographic and social patterns show a growing proportion of women who are the main breadwinners of their households, facing precarious working conditions and wages below the legal minimum, exposing their families to multidimensional poverty.
* Lack of an enabling environment for persons with disabilities: The number of persons with special needs and different abilities in society is increasing, without binding regulations ensuring their integration into the labour market and protecting them through fair wages that guarantee a dignified life.
International Commitments and Fundamental Labour Conventions
On this day, we recall the international and national obligations, foremost among them:
1. International Labour Organization Convention No. 100 concerning Equal Remuneration (Equal Remuneration Convention, 1951): which expressly provides for equality between men and women workers in remuneration for work of equal value without gender discrimination.
2. Minimum wage decisions and relevant national policies: which require wages to be aligned with the cost of living and national poverty levels, and ensure their effective implementation in all establishments.
Demands and a Call for Practical Action
The current stage confirms that Palestinian workers and the working class are not the only ones who should bear the cost of the multiple and compounded crises. Accordingly, we call for the following:
1. Reactivation of the Pay Equity Committee: as the comprehensive national framework designed to monitor gaps and regularly review wage policies.
2. Activation of the Wages Committee and establishing regular meetings: ensuring that the Wages Committee holds regular and continuous meetings to review wages and cost-of-living rates and link the minimum wage to ongoing economic changes.
3. Renewed regular monitoring and follow-up of the minimum wage: and requiring all workplaces to comply with the legally निर्धारित minimum wage without exceptions.
4. Development and activation of the sanctions regulations: reviewing and amending the sanctions system for those who violate the implementation of the minimum wage, and strengthening penalties so that they become deterrent and fair.
5. Strengthening the role of the Labour Inspection Department at the Ministry of Labour: activating the role of labour inspectors and requiring them to issue public monthly reports containing the scale of violations and the judgments issued concerning them across different productive and service sectors.
6. Comprehensive reform of the social protection system: linking the wage system with social security, health insurance and unemployment insurance to protect the most vulnerable groups.

From this platform, we declare our full commitment and the importance of raising the voice of the Palestinian trade union movement through the Equal Pay International Coalition (EPIC).
Active engagement and raising the standards of the Coalition’s work constitute a strategic entry point for unifying the efforts of the partner trade union movement at the international level, and for raising the Palestinian voice loudly in international forums and countries around the world; to exert pressure towards achieving genuine equity for women and men workers, and providing decent working conditions that preserve human dignity and protect the right of our people to life and social justice.
